Privacy Policy

Ceremoney is a brand of Software Reapplied Pty Ltd, the owner of the Ceremoney.co.za website (“the website”) and the Ceremoney App (“the App”). We have adopted this Privacy Policy, which describes how we process Personal Information collected by Ceremoney and the reasons for that collection or processing. In this Policy, our website, App and any other of our services are collectively referred to as our “Services”.
We recognise the importance of protecting privacy. Our Privacy Policy applies to all registered or non-registered users of our Services (“Users”). Where used in this Policy, the term “Personal Information” means any information identifying or describing an identifiable individual, including but not limited to information relating to their name, age, gender, reproductive status, marital status, national, ethnic or social origin, sexual orientation, physical or mental health, disability, conscience, belief, culture, language and birth; educational, criminal or employment history; financial status or information relating to financial transactions; and any identifying number, address or contact information of the individual.
Commitment to Privacy
We are committed to maintaining the confidentiality, integrity and security of personal information and we will take all appropriate technical and organisational security measures to ensure that where any personal information is provided to us it will be protected against loss, destruction and damage, and against unauthorised or accidental access, processing, erasure, transfer, use, modification, disclosure or other misuse.
We shall not disclose to any person any Personal Information of a data subject that is processed or hosted by us where any such disclosure would not comply in all respects with the provisions of any applicable data protection legislation or regulations.
We will ensure that Personal Information shall be:
- processed lawfully, fairly and in a transparent manner in relation to individuals;
- collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
- adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed;
- accurate and, where necessary, kept up to date;
- kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which it is processed; and
- processed in a manner that ensures appropriate security of the Personal Information, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage.
How We May Collect and Use Personal Information
When you visit or use the Ceremoney website or App, we automatically collect certain information about your device, which may include information about your web browser or operating system, IP address, time zone, and some of the installed cookies on your device. As you browse, we collect information about the individual pages you view, what websites or search terms referred you to our website, and how you interact with our website or App.
You can visit our website without telling us who you are or revealing any information by which someone could identify you. If you wish to use some of the website's features, download or use our App, receive our newsletter, or provide other details by filling a form, you may be required to provide Personal Information such as your email, first name, last name, city of residence, organisation, or telephone number.
We may also detect and log a User's location and IP address in order to identify the User's geographic region or time zone for routing traffic and managing time-sensitive tasks such as the sending of messages or notifications.
We may share your Personal Information with payment processors and payment facilitators in order to process your transactions. Unless you opt out of marketing communications, we may also use your Personal Information to notify you of product or service offerings that may be of interest to you.
APIs and Third-Party Processing
Where any Ceremoney Service acts as an API for the purpose of specifying how different software systems interact, you consent that we may pass and retrieve data, including personal information, between the different software systems and third parties that interact via those APIs.
We make use of the WhatsApp Business API service, in terms of which messages intended for display on mobile devices may be sent and received through Meta's WhatsApp systems over the Internet. WhatsApp messages may be routed through Meta's backend and the recipient's WhatsApp app. To ensure messages are properly delivered, Meta may use information like sender and recipient phone numbers, device identifiers and SIM card numbers. Users of our Services agree that their Personal Information may be shared with WhatsApp and used in terms of the policies and terms of WhatsApp available at whatsapp.com/legal/terms-of-service.
We engage only with reputed third-party service providers who have security and privacy policies and procedures providing at least the same level of protection as we do ourselves. Some of these third parties may be situated outside of your country and you consent to your personal data being transferred cross-border for us to provide the Services to you.

If you are a European resident, we note that we are processing your information to fulfil contracts we might have with you, or otherwise to pursue our legitimate business interests. Your information might be transferred outside of Europe, including to South Africa, Canada and the United States.
Personal Information of Minors
We do not intentionally collect personal identifiable information from anyone who is a minor. If it is discovered that we have unintentionally collected such information from a minor, we will delete that information immediately.
Information Security
We secure information you provide on computer servers in a controlled, secure environment, protected from unauthorised access, use, or disclosure. We maintain reasonable administrative, technical, and physical safeguards to protect against unauthorised access, use, modification, and disclosure of Personal Information. However, no data transmission over the Internet or wireless network can be guaranteed.
Legal Disclosure
We will disclose any information we collect, use or receive if required or permitted by law, such as to comply with a subpoena or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

Our website may contain links to other websites that are not owned or controlled by us. Please be aware that we are not responsible for such other websites or third parties' privacy practices. We encourage you to read the privacy statements of each website that may collect personal information.
Revisions and Termination
Our Privacy Policy may be updated from time to time at our discretion and changes will become effective upon posting to our website. If Ceremoney merges with, or is acquired by, any other business, you acknowledge and agree that your Personal Information may fall under the control of another person.
